Description
DD59/R/2/1 EXEMPLIFICATION OF ASSISE OF NOVEL DISSEISIN 8 Feb. 1435
Recites a writ of 3 Feb. 1435 from the King to the Treasurer ordering him to report on an assise of novel disseisin held at York on 3 Aug. 1422 between 1) Thomas Willesthorp, Henry Willesthorp clerk and William Willesthorp vs. 2) William Dayvell of Bylton about 1 a. of landcalled Pimfald, 2000a. of moor and 100a. of wood in Tockwith.
The reply, an Inspeximus of the assise, states that 2) claimed only 100a. of the moor which he claimed to have inherited from his father John, 1) state that they should be seised of the whole premises which descended to them from a certain John Willesthorp.
At the assise the 12 jurymen (named) said the John Dayvell did not die seised of the 100a. but that 1) were seised of the whole premises until 2) disseised them without right to their damages of 3s. 4d. and expenses & costs of 16s. 8d.
Therefore the jury consider that 1) should recover their seisin and damages and costs of 20s. also £4 for the expenses & costs of the Justices, amounting to 100s. in all. And 2) is in mercy.
Exemplification made at the request of Miles Willesthorp. Signed. Warham
